Criminal Law students' conference in Leiden


The "Criminal Law student society" of Leiden University (the Netherlands) is organising a student conference from Wednesday 23rd January - Friday 25th January 2008. ELSA London has been invited to send 10 students to participate in this international event. The cost for the particpants will be 50 euros (approx £31) - this includes cost for food, excursions, accommodation and transport whilst in the Netherlands. If you would like to be part of the conference, have a GENUINE interest in criminal law and are free between 23 - 25 January '08. Read on.

Invitation from SOS


From the 23rd until 25th of January, a student conference for European students interested in and studying criminal law will be held at Leiden University. The conference will be hosted by the "Studiekring Over Strafrecht" (SOS), the criminal law student-association of Leiden University. SOS exists of approximately 150 law students. Our activities include excursions to various courts (i.e. the Supreme Court, the ICC, the ICTY), law-firms, prisons etc.
Furthermore we organise monthly lectures by specialists on criminal law.



The conference we are currently organising offers the students a mixture of study, discussions, excursions to important international law institutions (such as the ICC, the ICTY, Europol). This way the participating students will be able to get to know other European students and their area of study.



The main theme of the conference will be "Limits to criminal law". To allow for a more in-depth discussion we will subdivide the group of in totally 50 students,10 students from the Faculty of Law of Leiden University and 40 students coming from other European Universities, into five study groups in which they will focus on a specific aspect of the main theme. At the end of the conference the groups will have to take position on their stand or subject and present this position to the group. During the presentation they will discuss the arguments they agreed on and difficulties they encountered. An expert will accompany each group.

The provisional positions for the study groups are as follows:

1. The European Union plays a key role in realising (cross border) anti-terrorism laws. Implementation of these laws and upholding them affect the legitimacy of Criminal Law.

2. The protection of society against risks, legitimises far-reaching intervention in individual freedoms and privacy rights. The balance between crime control and due process therefore rightly leans towards crime control.

3. Restorative Justice and Mediation better serve the aims of criminal law than traditional criminal penalties do.

4. A European Constitution, a European Public Prosecutor (EPP) and enhanced harmonisation of Criminal Law are necessary to realize a safe space as mentioned in Art. 29 EU-convention, which is one of the cornerstones of the
third pillar of the Union.

5. The European Court of Human Rights is not the most suitable body to comprehensively safeguard human rights in Europe.

Wednesday 23rd January:

1:45 pm - 3:45 pm: lecture
3:45 pm - 4:00 pm: break
4:00 pm - 6:0 pm: lecture
6 pm dinner at the restaurant of a students union Augustinus
8:00 pm - 10:00 pm 1st meeting of the study groups
Thursday 24th January:
9 am - 12:30 pm: 2nd meeting of the study groups
1 pm we will meet at the Central Station of Leiden to go to The Hague for an excursion. Excursions will be arranged for the ICC, ICTY and Europol
5 pm free time to go out to dinner or meet with the study group
Friday 25th January:
9-11 am: final meeting of the study groups
11 am - 1 pm: lecture
1 - 2 pm: lunch
2 - 4:30 pm: presentation of the outcome of discussions by each study group
4:30 pm: Prof. Cleiren will summarise and come to a final conclusion on the outcome of the congress.
